Terms of Service

Introduction These Terms of Service (“Terms”) are a legal agreement between you (“you,” “User”) and Togexa (“we,” “us,” or “our”). By accessing or using the Togexa website or services, you agree to these Terms. If you do not agree, do not use the Service.Eligibility and account rules

Peer network: The Service is a peer network for people with cerebral palsy. Access to peer spaces requires that users identify themselves as having cerebral palsy.Age rules:No independent accounts for children under 13.Ages 13–15: may join only with verifiable parental or guardian consent and supervision. A parent/guardian must complete the verifiable consent process or create the account on behalf of the minor.Ages 16 and older: may create accounts and use the Service independently.Accuracy: You must provide accurate information when creating an account and keep it up to date.Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Community standards and prohibited conduct You agree not to engage in the following:

Harassment, threats, stalking, or abusive behavior toward others.Sharing private health information of others without consent.Impersonation, misrepresentation, or creating false accounts.Posting illegal content, hate speech, or content that promotes self-harm or violence.Recording or distributing private content without explicit consent.Posting, sharing, or soliciting pornography, sexually explicit material, or sexual content of any kind.Soliciting sexual activity or engaging in sexually explicit private messaging within the Service.

2.Violations may result in content removal, account suspension, or permanent termination, at Togexa’s discretion.

Peer-only spaces and verification

Peer spaces are reserved for persons with cerebral palsy. Caregivers, clinicians, or service providers should use designated public resources or provider pages and must not join peer-only lounges unless explicitly invited or labeled multi-participant.We may request verification if a user’s account or behavior raises concerns. Providing false information may result in account termination.

Content ownership and license

You retain ownership of content you post.By posting content on Togexa, you grant Togexa a non-exclusive, worldwide, royalty-free license to host, reproduce, distribute, and display that content as necessary to operate the Service (including backups and cache).Content shared in peer spaces is visible to other members of those spaces and may be used in aggregated, de‑identified form for research and platform improvements.

Payments, donations, and third‑party services

Payments and donations are processed by third-party providers (PayPal and Stripe). Such transactions are subject to the providers’ terms and privacy policies.Events or registrations processed through Gobrunch are subject to Gobrunch’s terms.Refunds and cancellations: Specific event or paid program pages will include refund and cancellation policies at checkout.

No medical advice

Togexa is a peer network. Content provided by users is not medical, legal, or professional advice. Always consult a qualified professional for medical or legal decisions.

Prohibited content — sexual and adult material

The Service strictly prohibits pornography and sexually explicit material. This includes images, videos, text, links, and private messages that contain explicit sexual content or sexualized depictions of users.Any attempt to share, solicit, or distribute sexual content will result in immediate removal and review by moderators and may lead to permanent account termination and reporting to law enforcement when appropriate.

Reporting and moderation

Users may report content or behavior using the in-service reporting tools. Moderators will review reports and take appropriate action (content removal, warning, temporary suspension, or permanent ban).For threats or illegal content, we may disclose information to law enforcement as required.

Termination and suspension

Togexa may suspend or terminate accounts for violations of these Terms, legal requirements, or inactivity.You may close your account at any time via account settings or by contacting [email protected]. Some content (e.g., backups) may remain for a period consistent with our retention policy.

Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOGEXA PROVIDES THE SERVICE “AS IS” AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.IN NO EVENT SHALL TOGEXA BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.TOGEXA’S AGGREGATE LIABILITY FOR CLAIMS RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) IN THE PRIOR 12 MONTHS, OR $100 IF NO PAYMENTS WERE MADE.

Indemnification You agree to indemnify, defend, and hold Togexa harmless from any claim, loss, liability, or expense arising from your violation of these Terms or your actions on the Service.Governing law and disputes

These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict of law principles.Any legal action arising out of these Terms shall be brought in the state or federal courts located in [Insert county], Georgia.
